Italians seem to look less favorably on people being kidnapped off the street and sent to other countries to be tortured. They even charge the people responsible with crimes. I call that civilized because it repudiates violence and force and supports decent law.

This story made my day. Guess Darth Cheney and the W.P.E. won't be giving any speeches in Italy.

Unsurprisingly, one of the convicted CIA people, now retired, has raised the Nuremberg defence:
Speaking from a secret location, the now retired CIA man said: "I console myself by reminding myself that I was a soldier, that I was in a war against terrorism, that I couldn't discuss orders given to me."
Since Congress never issued a declaration of war as required by the US Constitution the Nuremberg defense, even if it were valid, wouldn't apply here.

Can you elaborate?
