All eyes were on the Supreme Court this morning as the nation awaited rulings on major cases related to immigration, criminal justice, campaign finance reform and health care. But true to form, the justices are holding their blockbuster case until the very end. We’ll find out Thursday morning whether ObamaCare passes constitutional muster.

Today, however, the court largely gutted Arizona’s anti-illegal immigration law, which was passed out of frustration with the federal government’s failure to control the border and enforce our immigration laws. A July 2010 Rasmussen poll found that 61% of likely voters would support a similar law in their own state. But the court’s majority reaffirmed the long-standing view that immigration enforcement is a federal responsibility with virtually no role for the states.

Arizona law enforcement officials will still be permitted to inquire about the immigration status of individuals who have already been stopped. Advocates of the law are suggesting that just the ability of local police to check the immigration status of a detained individual is of some deterrent value.

In his dissenting opinion, Justice Scalia, who would have upheld the entire Arizona law, observed, “Today’s opinion… deprives states of what most would consider the defining characteristic of sovereignty: the power to exclude from the sovereign’s territory people who have no right to be there.”

In another disappointing decision, the court’s liberal majority continued down the path it has been on for several years of restricting the right of states to establish their own laws and punishments. The court ruled 5-to-4 that mandatory life sentences for juveniles convicted of murder violated the Eighth Amendment prohibition against “cruel and unusual punishment.”

Several years ago, the Supreme Court banned the death penalty for juvenile murderers. Now it has essentially taken life sentences off the books too!
